What Makes A Trucking Accident Different From A Car Accident Case

Anyone who has the ability of sight will know that not all cars are the same, that is there are different categories of vehicles. There is of course, your average 4-wheeled car,  2-wheeled motorcycles and large 18-wheeled commercial trucks. Each of these vehicles have different capabilities that will make each of them attractive in one way or another due to each person’s specific agenda. That said, not only are the purposes of each vehicle different, but the accident cases between them are different as well.

Most people think that cases between vehicle types are the same and can be handled the same. So often, if one person has endured a case between two 4-wheeled cars, usually they think they know it all and are aware of the entire process of how a case is handled from start to finish, but the reality of things is different. As a personal injury lawyer like one from Eric Roy Law Firm can explain, what is looked at and what is considered and balanced is much different when the case shifts from two 4-wheeled cars to a 4-wheeled and an 18-wheeled commercial truck. Here’s how the cases can differ below:

Standards. No average person can just go out and drive a large 18-wheeler, you actually have to be trained and educated on the challenges of and special details regarding how to operate a large commercial vehicle. Since the driver will go through training that can last upwards of six months, after receiving a certification the courts will hold the driver to a different standard than that of a driver of a 4-wheeled vehicle. If a driver can’t adhere to the standards that they were trained to uphold while driving, then a greater degree of negligence is attributed to the case.

Dangers. The bigger the vehicle, the greater the potential for injury. Large commercial trucks handle differently than regular cars in the sense their sheer weight means they carry more momentum with them and can injure and destroy a vehicle in such a manner that a 4-wheeled car cannot. It’s because of this that most large truck related collisions end with deaths thus increasing the overall scrutiny regarding the case.

Injuries. As aforementioned above, the potential for fatalities in a commercial truck/car collision is already high so for those who manage to survive an accident, odds are they will be severely injured. These injuries usually alter the quality of life for the injured significantly if not permanently and this is on top of the financial challenges that it will bring. It’s injuries like these that also require a specialized handling  of the case as well.
